I know this website is very careful about copyrighted material. If this is clarified somewhere else, please point me to it. Here's what I understand and what I don't. Until recently, copyrighted material was protected for eighty years after the original copyright. Thanks to Mickey Mouse in Steamboat Willie, our federal legislators extended that to 100 years. I'm not sure how this applies to music or if all copyrighted material is treated the same. As regards to music, I would think that basically the melody, and lyrics are copyrighted, but lyrics with a chord sequence usually suggests the melody as well. When is it legal to publish for free or for sale ? Lyrics only ? Lyrics with chords ? Melody (with or without lyrics) I frequent two wonderful archives: http://levysheetmusic.mse.jhu.edu/ http://scriptorium.lib.duke.edu/sheetmusic/ Neither seems to post any music if sale of it would violate public domain laws, but as far as I can tell, nothing was removed when the law changed. Is previously public domained material grandfathered in? Performances: Does purchase of published, copyrighted sheet music give permission for performing and recording that music without paying royalties? Any other enlightenment would be appreciated.

Melody (with or without lyrics) I go by the general rule of thumb that if it was before 1923 it's in the public domain and if it's after 1923 it's copyright protected. I know that's not always the case but I think it's right most of the time. Does purchase of published, copyrighted sheet music give permission for performing and recording that music without paying royalties? Purchasing a piece of sheet music doesn't give you permission to perform or record the music without paying royalties. There are so many rules and regulations I wouldn't even pretend to try to keep up with them... that's why I use mostly songs that are pre-1923 on ezFolk... but most good old folksongs that have stood the test of time came into being before 1923 anyway, so it works out. Anytime I've recorded something that is copyright protected I've done the licensing through the Harry Fox Agency, which handles most of the licensing for music these days.
